crypto asset regulations — The U.S. Securities and Exchange Commission (SEC) is moving forward with its proposed digital asset rules, with the public comment period set to close on October 21, 2026.

The agency’s ‘Regulation Crypto Assets’ proposal, introduced in August, aims to establish a framework for certain investment contracts involving crypto assets. Over the 60-day comment window, the SEC gathered approximately 140 submissions from individuals and interest groups.

Comments addressed a proposed safe harbor provision that would prevent token issuers from being automatically classified as ‘investment contracts,’ as well as exemptions for offerings up to certain amounts. The Markets in Crypto Assets (MiCA) Crypto Alliance largely supported the SEC’s proposed changes to disclosure requirements but recommended amendments for clearer definitions.

SkyBridge Capital founder Anthony Scaramucci voiced support for the rules, stating they respond to ‘organic adoption’ and represent a return to the SEC’s proper role. Some legal experts, however, suggest the proposed rules could be more easily overturned than an act of Congress, such as the failed CLARITY Act.
