Former Senator Chris Dodd, ex-CFTC and SEC Chair Gary Gensler, the National Football League, 39 states, and 145 tribal nations filed amicus briefs last week asking the high court to take up a case determining whether these markets constitute swaps. The Supreme Court has not yet indicated if it will hear the case.
On Friday, the Commodity Futures Trading Commission released two related proposals, one of which is an interim final rule now in effect, outlining its own regulatory stance. The filings and rulemaking represent a significant coordinated effort to resolve long-standing legal uncertainty surrounding prediction markets, which often utilize blockchain technology and cryptocurrency for betting on event outcomes.
