Regulatory Clarity Advances Despite Failure of CLARITY Act

Regulators are moving ahead with crypto rules despite the U.S. Senate’s failure to advance the comprehensive CLARITY Act in September, according to analysis from CoinDesk’s Crypto for Advisors newsletter.
The CLARITY Act, which aimed to establish a legislated framework for digital assets and their intermediaries, did not pass a key Senate vote on September 15. Its failure leaves a comprehensive congressional solution for tokenized securities and money on hold.
However, the newsletter notes that regulatory clarity is arriving through other channels. Agencies are actively writing rules to fill the legislative void, providing a short-term boost to market certainty but creating potential longer-term risks from a patchwork of regulations.
The analysis suggests that while Congress stalls, regulators are effectively setting the rules of the road for the emerging digital asset economy, a development financial advisors must now navigate.
